Rental Agreement & Terms and Conditions
These terms apply to kayak, canoe, paddle, personal flotation device, pedal-drive, and related equipment rented from Sagebrush Outfitters, LLC.
1. Eligibility and responsibility
The primary renter must be at least 18 years old and legally able to enter into this agreement. The renter is responsible for the rental equipment and for making sure every participant uses it safely and lawfully.
2. Rental period and return
The rental period begins on the scheduled pickup or delivery date and ends on the stated return date. Equipment must be returned at the agreed time and location unless Sagebrush Outfitters approves a change in advance. Additional charges may apply for late returns that interfere with another reservation or require additional recovery work.
3. Equipment condition and inspection
The renter agrees to inspect the equipment before use and promptly report missing, damaged, or unsafe equipment. The renter must stop using equipment that appears unsafe or damaged and contact Sagebrush Outfitters for instructions.
4. Permitted use
Equipment must be used only for lawful recreational use and within the renter’s abilities. The renter may not intentionally misuse the equipment, operate it while impaired, use it in prohibited areas, alter it, or lend it to an unauthorized person. Personal flotation devices should be worn while on the water.
5. Loss, theft, and damage
The renter may be responsible for reasonable repair or replacement costs for equipment that is lost, stolen, intentionally damaged, or damaged through misuse, prohibited use, or failure to follow reasonable operating instructions. Ordinary wear from proper use is excluded.
6. Weather cancellation and refunds
If weather conditions make the rental unsafe or impractical, the renter may cancel at least 24 hours before the scheduled rental start for a full refund. If Sagebrush Outfitters cancels a reservation because weather or water conditions are unsafe, the renter may choose a full refund or reschedule the reservation. Refunds are returned through the original payment method and may take additional time to appear depending on the payment provider.
7. Customer cancellations not related to unsafe weather
Any cancellation or change that is not covered by the weather policy is subject to Sagebrush Outfitters approval. Customers should contact Sagebrush Outfitters as soon as possible if plans change.
8. Pickup and delivery
Customers choosing pickup must follow the current pickup instructions provided by Sagebrush Outfitters. Delivery is available only to locations and times shown during booking. The renter is responsible for being present and ready at the scheduled handoff time unless another arrangement is approved.
9. Liability waiver
The Rental Agreement is separate from the Liability and Waiver Policy. The renter must also accept the current Liability and Waiver Policy before completing a reservation.
10. Governing law and severability
These terms are governed by Idaho law. If any provision is found unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.
